Terms of Service

These Terms of Service ("Terms") govern your use of LinkGenie, including LinkGenie.com, the LinkGenie app at linkgenie.net, every LinkGenie bio page, digital business card, short link and QR code, and any related services (together, the "Service"). The Service is operated by GoHooper, LLC (LinkGenie, a GoHooper.com company; "LinkGenie", "we", "us" or "our"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use LinkGenie

You must be at least 18 years old (or the age of digital consent where you live, if higher) to create an account. If you use the Service for a business or organization, you confirm you are authorized to accept these Terms on its behalf.

2. Your account and username

  • You are responsible for your account, your login details and everything that happens under your account. Keep your password safe and tell us right away at info@linkgenie.com if you suspect unauthorized use.
  • Usernames (your LinkGenie link) are subject to approval and must be at least 6 characters long. We may change a username that does not meet this requirement, that infringes someone else's rights, or that is misleading.
  • To protect our brand, usernames and profile names may not include the word "Genie" or otherwise suggest they are an official LinkGenie account.
  • You agree to give accurate information when you sign up and to keep it up to date. Please confirm your email address using the activation email we send so you can manage your page.

3. Acceptable use

We want LinkGenie to be a safe place for creators, businesses and their audiences. You may not use the Service to:

  • send spam, or create links or link names that are "click-bait" without an honest description;
  • link to sites that have been reported as spam, phishing, malware or scams, or to any third-party site that threatens a visitor's safety;
  • impersonate any person, brand or organization, or create fake accounts;
  • promote dating services, gambling, lotteries or similar schemes, or scams of any kind;
  • share content that is illegal, infringes intellectual property or privacy rights, harasses or threatens others, or is sexually explicit without the sensitive-content warning the Service provides;
  • interfere with, overload, scrape or attempt to gain unauthorized access to the Service or other users' accounts.

We may remove content, suspend or permanently terminate accounts that break these rules, with or without notice, and may ban repeat or serious offenders.

4. Your content

You keep ownership of everything you add to your LinkGenie page: links, text, images, videos and other material ("Your Content"). You give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and adapt Your Content only as needed to operate, improve and promote the Service (for example, showing your public page or featuring it as an example, which you can ask us to stop at any time). You confirm you have the rights to Your Content and that it complies with these Terms.

LinkGenie pages are built by their owners. Links, images, websites and text on a user's page are not operated or endorsed by LinkGenie, and we are not responsible for anything you click on from someone else's page.

5. Plans, billing and cancellation

  • The Basic plan is free. Paid plans (such as PRO and PRO+) are billed in advance, monthly or yearly, at the price shown when you subscribe. Current plans and prices are listed on our pricing page.
  • Payments are processed securely by our third-party payment processors. We do not store your full card details.
  • Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel any time from your account, and your access to paid features continues until the end of the billing period you have already paid for.
  • We do not provide refunds or credits for partial billing periods, except where required by law. Questions about a charge? Contact info@linkgenie.com.
  • We may change plan features or prices. Price changes apply from your next billing period and we will tell you in advance.

6. Verified badges and PRO features

PRO account owners who have added a valid payment method and upgraded their profile may request a verified badge. We may also verify accounts based on other criteria at our discretion, and we may remove a badge if these Terms are broken.

7. Third-party services

The Service lets you link to, embed or connect third-party services (for example social networks, YouTube, Vimeo, Spotify, SoundCloud, analytics or tracking pixels, and payment providers). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. LinkGenie is an independent service and is not affiliated with, sponsored or endorsed by Instagram, Meta, TikTok, X, Google or any other platform where you share your link.

No affiliation with Instagram. LinkGenie has no affiliation with Instagram and does not claim any endorsement from Instagram or any of its subsidiaries.

8. Our intellectual property

The Service, including the LinkGenie name, logo, genie mark, software, designs and content we provide (other than Your Content), belongs to GoHooper, LLC and its licensors and is protected by law. You may not copy, modify or use our trademarks without our written permission.

9. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you break these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (such as content licences already granted for past use, disclaimers, limitation of liability and indemnity) will survive.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted, error-free or that your page or analytics data will always be available.

11. Limitation of liability

To the fullest extent permitted by law, GoHooper, LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the fees you paid us for the Service in the 12 months before the event giving rise to the claim.

12. Indemnity

You agree to defend, indemnify and hold harmless GoHooper, LLC, its affiliates and team from claims, damages and costs (including reasonable legal fees) arising from Your Content, your use of the Service or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Palm Beach County, Florida, unless applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date, and for material changes we will give notice by email or in the app. Continuing to use the Service after changes take effect means you accept them.
